PERLINDUNGAN HUKUM TERHADAP SERTIFIKASI HALAL DENGAN MODEL SELF DECLARE

Abstract

Indonesia, which is a Muslim-majority country, is present and responsible for the comfort and certainty of consuming halal products. Law Number 33 of 2014 concerning Halal Product Assurance and the Job Creation Law is one of the legal products that provide various conveniences for the people of Indonesia. This law provides simplification and acceleration of the business licensing process in Indonesia which previously seemed quite complex. In addition, there is also the convenience of the Job Creation Law regarding halal certification which will help MSE actors to carry out their obligations simply with the Self Declaration model. Self-declaration of halal certificates for Micro and Small Enterprises (MSEs) is regulated in Article 79 of Government Regulation Number 39 of 2021 concerning the Implementation of the Field of Halal Product Assurance. In this regulation, BPJPH must create a mechanism related to self-declaration. BPJPH is mandated to establish halal standards that will be a reference for the implementation of self-declaration. In Government Regulation Number 39 of 2021, it is stated that make self-declarations will receive assistance. Later, the companion will verify and validate related to the halal declaration of MSEs to know clearly and in detail how the mechanism for implementing halal self-declare certification.
